Stompt

These are the rules for using Stompt. They're a contract between you and Robert Paul, sole proprietor, who makes and runs the app. By downloading or using Stompt you agree to them. If you don't agree, don't use the app. These Terms supplement Apple's Standard End User License Agreement, which governs the licence to the iOS app. If the two conflict about that licence, Apple's Standard EULA controls.
Read the safety section. Skateboarding can seriously injure or kill you. Stompt is a camera and a measuring tool — not a coach, not a spotter, and not a doctor. Everything you do on a board is your own risk.
Stompt is an iPhone app. You prop your phone, you skate, and it films each attempt on its own — it watches for the movement that means an attempt happened and trims a clip around it. It then gives you a slow-motion review with measurements of how your body moved.
You supply the trick and the verdict, not the app. You choose the trick you are working on before you film, and you confirm make or bail yourself in review. Stompt does not identify which trick you did, does not decide whether you landed it, and does not count board flips. Your trick tree advances from the verdicts you confirm.
The parts that are automatic — spotting attempts, trimming clips, and measuring body movement — are software making its best guess. They will sometimes be wrong. Stompt may miss an attempt entirely, trim one badly, film something that was not an attempt at all, or produce a measurement that is off. Stompt is a training aid, not a judge and not a scientific instrument.
You must be at least 13 years old. If the law where you live requires a higher minimum age or verified parental authorisation for an online service, that higher requirement applies. If you are under 18, you must have a parent or guardian's permission before you use Stompt, and that adult agrees to these terms on your behalf.
You need your own account, and you must give accurate sign-in information. You are responsible for what happens under your account — don't share it. Tell support@stompt.app promptly if you believe someone else has accessed it.
Skateboarding is dangerous. It carries a real risk of serious injury, permanent disability and death. That risk is yours, it exists whether or not you use this app, and nothing in Stompt reduces it.
You use Stompt entirely at your own risk, and you accept full responsibility for every injury, loss or damage arising from skateboarding while using it.
Stompt records video with audio. Spots are public places with other people in them.
If someone is identifiable in your footage — on camera or by their voice — that is your responsibility, not ours. You agree that:
If a claim is made against us because of something you filmed, you agree to cover us for it (see section 11).

Prices are in US dollars and are what the App Store charges in the United States; in other countries the App Store shows the local price, which may differ. The price shown in the app at the moment you subscribe is the price that applies.
The annual plan includes a 3-day free trial for users the App Store considers eligible. Apple decides introductory-offer eligibility for the subscription group, and subscribing to another plan in the group may affect that eligibility. The App Store purchase sheet shows the trial, price and effective date that apply to your purchase; check it before confirming. If you don't cancel at least 24 hours before an annual trial ends, it converts into a paid annual subscription and you are charged. Any unused part of a trial may be forfeited when another subscription is purchased, as Apple explains on the purchase sheet. The monthly plan has no trial.
Purchases go through Apple, so refunds are Apple's to give. Request one at reportaproblem.apple.com. We cannot issue refunds for App Store purchases. Except where the law requires otherwise, payments are non-refundable and there are no refunds for partial periods.
We may change prices or what's in a plan. If a price change would affect your renewal, Apple will notify you and, where Apple requires it, ask you to agree before charging you. If you don't want the new price, cancel before the next renewal.
You own your clips, your poster frames, your movement data and everything else you create with Stompt. We claim no ownership of it.
To be able to run the app at all, you grant us a limited licence to store, host, transmit, encode and process your content — and to display it back to you inside the app. That licence exists only to provide the service to you, it is not exclusive, and we make no money from it. It ends when you delete the content or your account, except for temporary protected disaster-recovery copies and records that must be retained for legal or security reasons as described in the Privacy Policy.
That licence is deliberately narrow. We do not have the right to publish your footage, to show it to other users, to put it in marketing, to license it to anyone else, or to use it to train any machine-learning model. If we ever wanted to use a clip of yours publicly, we would have to ask you first.
The app itself — the software, the name, the logo, the design and the analysis models — belongs to Robert Paul and is protected by copyright and trade mark law. Subject to Apple's Standard EULA and the App Store Usage Rules, your subscription gives you a personal, non-transferable, revocable licence to use Stompt on Apple-branded products you own or control. Access permitted through Family Sharing or volume purchasing is governed by Apple's rules. The subscription does not transfer any ownership.
What Stompt collects and what happens to it is set out in the Privacy Policy, which is part of these terms. Read it — in particular the sections on what uploads automatically, and on the pose record.
You can delete your account at any time in YOU → Delete account. Note that deleting the account does not cancel your App Store subscription — you must cancel that separately in iOS Settings.
We try to keep Stompt working, but we don't promise it always will. The service may go down for maintenance, because a hosting provider has a problem, or for no reason we controlled. Features may change or be removed. We may stop offering the app.
Keep your own copies of anything you care about. Stompt uploads footage to private cloud storage, but that is storage, not a restore feature: the app only sends data up and never reads it back down, so it cannot repopulate your library on a new, reset or replaced phone, and it does not sync between devices. Signing in on a second device shows an empty library. Remember too that not every attempt is uploaded — unkept bails never leave your phone. For eligible bails, CLEAR removes the clip, poster frame and pose record from the phone immediately and queues removal of any cloud copies; the attempt's history record remains. Your own device backup, and your own copies, are what protect your footage.
Stompt is provided "as is" and "as available", without warranties of any kind, whether express or implied. To the fullest extent the law allows, we disclaim all implied warranties including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, secure, or that its attempt detection, clip trimming or measurements will be accurate, nor that footage uploaded to cloud storage will be preserved or recoverable.
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, exemplary or punitive damages; for lost data, lost footage, lost profits or lost opportunity; or for personal injury or death arising from skateboarding, however caused.
Our total liability to you for any claim relating to Stompt is capped at the greater of $100 or the amount you actually paid us in the 12 months before the claim arose.
Some places don't allow certain warranty disclaimers or liability limits. Where that applies to you, those parts apply to you only to the extent the law permits, and nothing here limits liability that cannot lawfully be limited.
You agree to defend and cover Robert Paul against claims, damages, losses and reasonable legal costs arising from your use of Stompt, your breach of these terms, your content, or anyone appearing in footage you filmed.
You can stop at any time: cancel the subscription in iOS Settings, delete your account in the app, and delete the app.
We may suspend or terminate your access if you break these terms, if we're required to by law, or if we discontinue the app. Where it's reasonable to do so we'll give you notice. App Store refunds are decided and issued by Apple; Stompt can provide reasonable information to support a request but cannot promise that Apple will approve it.
Provisions that by their nature should continue after termination — including content responsibility, ownership, disclaimers, liability limits, indemnity and dispute terms — survive the end of these Terms.
If you believe content stored through Stompt infringes your copyright, privacy, publicity or other rights, email support@stompt.app with enough information to identify the work or right, locate the material, contact you, and understand the basis of the complaint. Stompt may remove material, restrict access or terminate repeat or serious violations when appropriate.
We may update these terms. The "last updated" date at the top will change, and for significant changes we'll notify you in the app before they take effect. Continuing to use Stompt after that means you accept the new terms. If you don't accept them, stop using the app and cancel your subscription.
Before filing a formal claim, you and Stompt agree to try in good faith to resolve the dispute informally. Send a written description of the problem and the relief requested to support@stompt.app. If it is not resolved within 30 days after receipt, either side may pursue the remedies available under applicable law.
These terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in California, and you and we both consent to those courts' jurisdiction. If you're a consumer somewhere with laws that give you a right to bring a claim locally, this doesn't take that right away.
These Terms do not require arbitration and do not waive any right to participate in a class action or to have a court or jury decide a claim.
You represent that you are not located in a country subject to a United States government embargo or designated by the United States government as supporting terrorism, and that you are not listed on a United States government list of prohibited or restricted parties. You must comply with applicable export-control and sanctions laws and with applicable third-party agreements when using Stompt, including Apple Media Services and any wireless-data-service terms.
